Terms & Conditions

1. About Us:

This website, https://guybutchers.com, is operated by Up-To-Date Information Services under the name UTD Books.

Postal address: Davey’s Lane, Bardwell, Suffolk, United Kingdom
Email: [email protected]

These Terms & Conditions apply to orders placed through our website and to your use of the website.

2. Our Products:

UTD Books offers physical books through this website. eBooks by Guy Butchers are available to purchase through Amazon Kindle.

Physical books ordered through our website are supplied as printed products. Kindle eBooks are purchased and delivered through Amazon and are subject to Amazon’s applicable terms and policies.

We make reasonable efforts to ensure that book descriptions, photographs, digital product details and prices are accurate. If we discover a material error affecting an order, we will contact you to explain the available options.

Please review the relevant product description before purchasing. For Kindle eBooks, please refer to the product information and purchasing terms displayed by Amazon.

3. Prices and Additional Charges:

Prices are displayed in pounds sterling (GBP), unless stated otherwise.

Any applicable delivery charges and other mandatory charges will be shown before you complete your purchase.

Physical books ordered through our website may incur delivery charges, which will be displayed at checkout where applicable. eBooks are available through Amazon Kindle; please refer to Amazon for Kindle prices and purchase details.

We will not impose additional charges that require your consent without obtaining it where required by law.

4. Payment:

Orders are placed through our WooCommerce checkout. Payments are processed using the Lloyds Bank Cardnet payment gateway configured on our website.

You must provide accurate information and complete the payment process at checkout.

If payment is declined or cannot be confirmed, we may be unable to process your order. We will not knowingly treat an unsuccessful payment as a completed paid order.

5. Orders and Contract Formation:

Before placing an order, please check your selected book or eBook, quantity, billing information and, where applicable, delivery address.

When you submit an order, you are making an offer to purchase the selected products.

We will send an order acknowledgement by email. We will communicate acceptance of the order and its status by email or another appropriate checkout confirmation. The order contract is formed when we accept your order.

If we cannot accept an order, we will notify you and refund any payment taken for an order that we do not fulfil, where applicable.

We will provide order confirmation and relevant contract information in a format you can keep for future reference.

6. Printing and Fulfilment:

We use BookVault to print and fulfil physical book orders. Necessary order information may be shared with BookVault so it can prepare and ship your purchase.

BookVault’s role in our ordering process concerns physical book printing and fulfilment. Digital products are supplied through the applicable digital delivery method offered on our website.

Using an external printing or fulfilment provider does not remove our responsibilities to you under applicable consumer law.

7. Delivery:

7.1 Physical Books:

Available delivery options, charges and estimated delivery times will be shown at checkout where available.

We will deliver your order within the agreed period or, if no other period has been agreed, within the period required by applicable law.

Delivery estimates may be affected by printing, postal or courier delays. If a problem arises, please contact us at [email protected].

You should provide a complete and accurate delivery address. Contact us as soon as possible if you notice an error. We will try to help, but a change may not be possible once printing or fulfilment has started.

7.2 eBooks on Amazon Kindle:

eBooks by Guy Butchers are available to purchase and read through Amazon Kindle. Kindle purchases and digital delivery are handled by Amazon and are subject to Amazon’s applicable terms and policies.

For questions about a Kindle purchase, delivery or access to an eBook, please contact Amazon Kindle support.

8. Cancellations, Returns and Refunds:

Your rights to cancel an online order, return goods and receive a refund are explained in our Delivery & Returns Policy.

8.1 Physical Books:

Consumers generally have a statutory right to cancel an online purchase of physical goods within 14 days after receiving the goods, subject to applicable exceptions.

A book being printed on demand does not, by itself, automatically remove this cancellation right. An exception may apply in specific circumstances, such as where goods are made to the consumer’s specifications or clearly personalised.

Where a statutory cancellation right applies, the relevant return and refund requirements will be followed.

8.2 Kindle eBooks:

Kindle eBook purchases are made through Amazon, not through our website. Cancellation, return and refund requests for Kindle purchases are handled under Amazon’s applicable policies and the law that applies to the purchase.

Nothing in these Terms & Conditions limits any statutory rights that cannot lawfully be excluded.

9. Faulty, Damaged or Misdescribed Products:

9.1 Physical Books:

If a book is faulty, damaged or not as described, contact us at [email protected] with your order details and, if possible, photographs of the problem.

We will assess the issue and provide the remedy required by applicable consumer law. Depending on the circumstances, this may include a refund, replacement or another legally applicable remedy.

9.2 Kindle eBooks:

If you experience a problem with a Kindle eBook, such as difficulty accessing it or an issue with the digital content, please contact Amazon Kindle support for assistance with your purchase.

Your statutory rights concerning faulty or misdescribed products are not excluded or restricted by these Terms & Conditions.

10. Intellectual Property:

Unless otherwise stated, the copyright and other intellectual property rights in our books and website content belong to the relevant rights holder.

Purchasing a physical book does not transfer copyright in that book to the purchaser.

Purchasing a Kindle eBook gives you access to the digital product subject to Amazon’s applicable Kindle terms and licence, as well as the rights granted by law.

Unless authorised by the relevant rights holder or permitted by law, you must not reproduce, distribute, republish, resell or commercially exploit our book content or website content.

Nothing in this section restricts any use permitted by applicable copyright law.

11. Acceptable Use of the Website:

You must not use our website for unlawful purposes or knowingly attempt to interfere with its security or operation.

You must not knowingly introduce malicious software, attempt unauthorised access or misuse the website in a way that could affect its operation or other users.

We may take reasonable steps to protect the website and its users from misuse, fraud or security threats.

12. Liability and Consumer Rights:

Nothing in these Terms & Conditions excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under UK law.

Subject to that requirement, we are not responsible for losses that are not reasonably foreseeable and do not arise naturally from a breach of these Terms & Conditions.

Nothing in this section affects your statutory rights if physical goods or digital content are faulty, not as described or otherwise fail to meet the requirements of applicable law.

13. Privacy:

We handle personal information in accordance with our Privacy Policy.

Our Privacy Policy explains how we use information to manage website orders, process payments, arrange physical book printing and delivery, and respond to customer enquiries. Kindle eBook purchases are handled by Amazon under its applicable privacy practices and policies.

14. Changes to These Terms:

We may update these Terms & Conditions when our website, business practices or legal obligations change.

The version applying to an order will be made available to you when you place that order. Changes will not remove rights you already have under applicable law.

15. Governing Law:

These Terms & Conditions are governed by the laws of England and Wales, except where mandatory consumer protection laws applicable to you provide otherwise.

If you are a consumer living elsewhere in the United Kingdom or another jurisdiction, you may also benefit from mandatory protections under the law applicable to your circumstances.
